Terms of service

These Terms of Service (“Terms”) govern your access to and use of the PetRide website (the “Site”) and any purchase of products from us. The Site and the products are operated and supplied by Skin Formular Pty Ltd (ABN 28 692 851 255) trading as “PetRide” (“PetRide”, “we”, “us”, “our”). In these Terms, “you” means the person accessing the Site or placing an order. Please also read our Privacy Policy, Shipping Policy and Refund Policy, which form part of these Terms.

1. Acceptance and eligibility
By accessing the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site. You must be at least 18 years old and able to enter into a binding contract, or use the Site under the supervision of a parent or guardian who agrees to these Terms. We may refuse access to anyone who doesn't meet these requirements.

2. Your account
You may need an account to make purchases. You agree to provide accurate, current and complete information and keep it up to date, and you're responsible for keeping your login details secure and for activity under your account. Tell us promptly at support@petride.com.au if you suspect unauthorised use. We may suspend or close an account we reasonably believe has been used in breach of these Terms, fraudulently, or in a way that creates a security or legal risk. You may close your account at any time.

3. Orders and order acceptance
Each order you place is an offer to buy products on these Terms. Our confirmation email acknowledges we've received your order; it is not acceptance of it. A binding contract is formed only when we dispatch the products to you (or, for part-shipments, when we dispatch each part). Until dispatch, we may accept or decline your order in whole or in part. We may refuse, cancel or limit any order — including after our confirmation email — for any reasonable reason, such as: the product is unavailable; there's an error in the price, description or image; we suspect the order is fraudulent or unauthorised; we can't verify your payment or delivery details; or the order exceeds purchase limits we've set. If we cancel an order you've already paid for, we'll refund the amount paid for the cancelled items in full to your original payment method.

4. Pricing and pricing errors
All prices are in Australian dollars (AUD) and, unless stated otherwise, include GST. Prices, descriptions and availability may change at any time before we accept your order. If a product's correct price is higher than the price shown and the error is obvious, we're not required to supply at the incorrect price — we'll contact you before dispatch to offer the correct price or cancel the order, and refund you in full if you've already paid.

5. Payment
You must pay in full at checkout using one of our accepted payment methods. By submitting payment details you confirm you're authorised to use the payment method. Payment is processed by our third-party payment providers; we don't store full card details. We'll provide a tax invoice for your purchase. If a payment is declined, reversed or charged back, we may cancel or suspend the related order and recover amounts owing to us.

6. Shipping
Shipping costs, methods and estimated timeframes are set out in our Shipping Policy, which forms part of these Terms. Delivery timeframes are estimates only and are not guaranteed. Risk in the products passes to you on delivery to the address you provide. Title passes to you once we've received payment in full.

7. Returns and your consumer rights
Our Refund Policy forms part of these Terms and explains how to return products and our change-of-mind conditions. Change-of-mind returns are offered at our discretion on the terms in that policy, and are separate from, and additional to, your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

8. Intellectual property
All content on the Site — including the PetRide name, logos, text, graphics, product images, layouts and software — is owned by or licensed to us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Site for your own personal, non-commercial use. You must not copy, reproduce, modify, distribute, scrape, data-mine or commercially exploit any part of the Site or its content without our prior written consent.

9. Acceptable use
When using the Site you must not: break any law or these Terms; interfere with the Site or its security; attempt unauthorised access to systems or accounts; use bots or scrapers (except standard search-engine indexing); transmit malware; place fraudulent or bad-faith orders; or use the Site or its content in a way that infringes others' rights. We may take reasonable action in response to a breach, including removing content, suspending access, or cancelling orders.

10. Reviews and submissions
If you submit a review, photo or other content, you confirm it's your own, accurate and lawful, and you grant us a worldwide, royalty-free, perpetual, irrevocable, transferable and sub-licensable licence to use, reproduce, edit, publish and display it in connection with the Site and our marketing. You must not post content that's false, misleading, defamatory or offensive. We may moderate, edit or remove submissions but aren't obliged to monitor them.

11. Third-party links
The Site may link to third-party websites we don't control. We provide these links for convenience only and aren't responsible for those sites' content, products or privacy practices.

12. Disclaimers
To the maximum extent permitted by law, and subject to the clauses below, the Site and its content are provided “as is” and “as available”. We don't warrant that the Site will be uninterrupted, error-free or secure, or that information on the Site is complete or current. Product information is general only and is not veterinary advice — please consult a qualified vet about your animal's specific needs. Nothing in this clause limits or excludes the consumer guarantees that apply to the products you buy from us.

13. Your consumer rights (this clause prevails)
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded (your “Non-excludable Rights”). If any part of these Terms would do so, that part does not apply to the extent of the inconsistency, and your Non-excludable Rights prevail.

14. Our liability
Subject to, and without limiting, your Non-excludable Rights, and to the maximum extent permitted by law: (a) our total liability arising out of or in connection with the Site, the products or these Terms — whether in contract, tort (including negligence), under statute or otherwise — is limited, at our option, to resupplying, repairing or replacing the relevant products, paying the cost of doing so, or refunding the amount you paid for them; (b) we aren't liable for any indirect, special or consequential loss, or any loss of profit, revenue, data, goodwill or business opportunity; and (c) we aren't liable for loss or damage to the extent caused or contributed to by you, a third party, or something beyond our reasonable control. Paragraphs (a)–(c) do not apply to your Non-excludable Rights.

15. Indemnity
You agree to indemnify us against any reasonable loss, damage, cost or expense we incur arising from your breach of these Terms, your misuse of the Site, your submissions, or your breach of any law or third-party rights. This indemnity doesn't apply to the extent the loss was caused by our own negligence or breach, and is reduced to the extent we contributed to or could reasonably have mitigated the loss.

16. Suspension and termination
We may suspend, restrict or terminate your access to the Site or your account if you breach these Terms, or where reasonably necessary to protect us, our customers or our systems. Where practical and lawful we'll give you notice. You may stop using the Site at any time. Termination doesn't affect rights or obligations that accrued beforehand, including your consumer guarantee rights and our right to be paid for products already dispatched.

17. Changes to these Terms
We may update these Terms from time to time. The version that applies to your order is the one published on the Site when you place that order. Changes don't apply retrospectively to orders we've already accepted. Your continued use of the Site after changes take effect means you accept the updated Terms.

18. Governing law
These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them. This doesn't deprive you of the protection of any consumer laws of the place where you live.

19. General
If any part of these Terms is found to be void or unenforceable, that part is severed and the rest continues in force. These Terms, together with our Privacy Policy, Shipping Policy and Refund Policy, make up the entire agreement between you and us about your use of the Site and your purchases — except that nothing in this clause limits liability for fraud or misleading conduct, or your rights under the Australian Consumer Law.
